Welcome to HnK Party. By accessing our website, placing an order, booking a rental, making a payment, or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use our website or services.

1. Business Information

HnK Party provides event decoration products, rental equipment, event styling accessories, party supplies, delivery services, setup services, and related event services throughout Australia.

Throughout these Terms:

• "HnK Party", "we", "our", or "us" refers to HnK Party.
• "Customer", "you", or "hirer" refers to the person, business, or organisation hiring products or using our services.

2. Acceptance of Terms

By:

• requesting a quote;
• accepting a quote;
• paying a deposit;
• making a booking;
• signing an invoice;
• accepting delivery; or
• using our website,

you acknowledge that you have read and accepted these Terms and Conditions.

3. Quotations

3.1 Validity

All quotations are valid for fourteen (14) days unless otherwise stated.

3.2 Availability

Quotes are subject to product availability at the time the booking deposit is received.

3.3 Errors

HnK Party reserves the right to correct any pricing, calculation, or typographical errors before accepting a booking.

4. Bookings and Deposits

4.1 Booking Confirmation

A booking is only confirmed once:

• the required deposit is paid; and
• written confirmation is issued by HnK Party.

4.2 Deposit Amount

A non-refundable booking deposit may be required to secure rental items or event services.

4.3 Final Payment

Unless otherwise agreed:

• Full payment must be received at least seven (7) days before the event date.
• Bookings made within seven (7) days of the event require immediate full payment.

4.4 Failure to Pay

Failure to make payment by the due date may result in cancellation of the booking without refund.

5. Security Bond

5.1 Bond Requirement

HnK Party may require a refundable security bond before releasing rental items.

5.2 Bond Deductions

The security bond may be used for:

• lost items;
• damaged items;
• excessive cleaning;
• late returns;
• repair costs;
• replacement costs;
• unpaid balances.

5.3 Refund

Security bonds will typically be refunded within seven (7) business days after inspection of returned items.

6. Rental Period

6.1 Hire Duration

Rental periods are specified on the booking confirmation.

6.2 Extended Use

Items retained beyond the agreed return date may incur additional rental charges.

6.3 Unauthorised Extension

The customer must not extend the rental period without written approval.

7. Delivery and Collection

7.1 Delivery Charges

Delivery fees are calculated separately and are based on distance, travel time, tolls, labour requirements, and accessibility.

7.2 Access Requirements

Customers must ensure:

• safe site access;
• suitable parking;
• reasonable loading access;
• clear instructions for setup locations.

7.3 Delays

HnK Party will not be liable for delays caused by:

• traffic;
• weather;
• accidents;
• road closures;
• venue restrictions;
• events beyond our reasonable control.

7.4 Failed Delivery

Where delivery cannot be completed due to customer circumstances, additional delivery fees may apply.

8. Setup and Pack Down

Where setup services are included:

• customers must ensure the venue is ready upon arrival;
• setup times are estimates only;
• additional labour charges may apply if delays are caused by the venue or customer.

If pack-down services are included:

• items must remain accessible at the agreed collection time.

9. Customer Responsibilities

The customer agrees to:

• use all items responsibly;
• supervise children around rental equipment;
• follow any safety instructions provided;
• keep items protected from weather and misuse;
• return items in the same condition supplied.

The customer must not:

• modify equipment;
• repaint or alter products;
• attach permanent fixtures;
• sub-hire items to third parties.

10. Loss, Theft and Damage

10.1 Responsibility

The customer is responsible for all rental items from delivery or collection until returned to HnK Party.

10.2 Damage Charges

Customers are responsible for:

• repair costs;
• replacement costs;
• cleaning costs;
• transportation costs associated with damaged items.

10.3 Total Loss

If an item is lost, stolen, destroyed, or beyond repair, the customer will be charged the full replacement value.

10.4 Weather Damage

Items damaged by:

• rain;
• wind;
• flooding;
• extreme heat;
• storms;

while under customer control remain the responsibility of the customer.

11. Balloons and Decorative Products

11.1 Balloon Lifespan

Balloons are temporary decorative products. HnK Party does not guarantee balloon performance due to:

• temperature changes;
• sunlight exposure;
• wind;
• venue conditions;
• handling after setup.

11.2 Outdoor Installations

Outdoor decorations are installed at the customer's risk. Weather-related deterioration is not considered a defect.

12. Cancellation Policy

12.1 Customer Cancellation

Cancellation fees may apply as follows:

Less than 14 days	No refund

12.2 Rescheduling

Rescheduling requests are subject to availability.

12.3 Force Majeure

HnK Party may reschedule services affected by:

• natural disasters;
• government restrictions;
• severe weather;
• public emergencies.

13. Photographs and Marketing

Unless the customer specifically requests otherwise in writing, HnK Party may:

• photograph completed setups;
• use event photos;
• share images on social media;
• use images in marketing materials.

No personal information will be disclosed without consent.

14. Website Use

Users must not:

• interfere with website functionality;
• attempt unauthorised access;
• distribute malicious software;
• copy content without permission.

All website content remains the property of HnK Party.

15. Intellectual Property

All:

• logos;
• designs;
• graphics;
• photographs;
• branding;
• website content;

remain the property of HnK Party and may not be reproduced without written consent.

16. Limitation of Liability

To the maximum extent permitted by law, HnK Party is not liable for:

• indirect losses;
• consequential losses;
• loss of profits;
• loss of business opportunities;
• event disruptions beyond our control.

Our liability is limited to the amount paid by the customer for the relevant booking, subject to Australian Consumer Law protections.

18. Indemnity

The customer agrees to indemnify and hold harmless HnK Party, its employees, contractors, and representatives against any claim, loss, damage, liability, cost, or expense arising from:

• misuse of rental products;
• breach of these Terms;
• negligent acts or omissions of the customer or their guests.

19. Privacy

Any personal information collected will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

20. Recovery of Equipment

If rental items are not returned:

• HnK Party may charge additional rental fees;
• replacement charges may apply;
• debt recovery action may be commenced;
• collection costs may be added to the outstanding balance where permitted by law.

21. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

22. Changes to Terms

HnK Party reserves the right to update these Terms and Conditions at any time. The latest version will always be available on our website.
